LLH Operations LLP et al. v. Samson Resources Company, No. 09-CV-0006730-WDM-KMT (U.S. District Court for the District of Colorado)

Plaintiffs filed this action in the District Court of La Plata County, Colorado on February 20, 2009, challenging Samson’s deduction of certain expenses from royalty payments on gas produced from wells located in LaPlata County, Colorado. On March 25, 2009, Samson removed this case to the United States District Court for the District of Colorado, which has since retained jurisdiction of the action pursuant to federal law.

The Plaintiffs are represented by G. R. Miller of Miller, Agro & Robbins, LLC, of Durango, CO and Thomas D. Kitch, Gregory J. Stucky, and David G. Seely of Fleeson, Gooing, Coulson & Kitch, L.L.C., of Wichita, KS.

On January 15, 2010, the parties to the lawsuit executed an Agreement for Settlement.

On February 17, 2010, the Court entered an Order Conditionally Certifying a Settlement Class, Preliminarily Approving Settlement Agreement, Approving Form of Notice, and Scheduling Fairness Hearing.

On April 2, 2010, Plaintiffs’ counsel mailed a copy of a Notice of Class Action and Proposed Settlement to each member of the Plaintiff Class at the most recent address known to Samson.

On May 26, 2010, the Court approved the proposed settlement and request for attorney fees and expenses.
